By this notice, a landlord may inform a tenant of the termination of a lease for breach of the lease. This action may be taken under a lease, provided that there are specific lease provisions that allow this action, and the tenant has agreed to these provisions by signing the lease. This notice is generally sent to a tenant after the tenant has first been notified that the rent is past due, and the tenant has been given a time period in which to pay. This notice is not an eviction notice. It is a notice to demand that the tenant surrender possession of the property back to the landlord. A lawyer should be consulted for further action, which may involve a lawsuit to enforce the lease terms, a lawsuit for collection of the past-due rent, or legal proceedings for eviction of the tenant. A copy of the original lease should be attached to this form. This form should be delivered to the tenant by certified first-class mail, and the Proof of Service portion of this form should be completed by the person actually mailing the notice.
