This form is to be used for the sale and transfer of real estate. Although most real estate sales today are handled by real estate professionals, it is still perfectly legal to buy and sell property without the use of a real estate broker or lawyer. Please note, however, that there may be various state and local variations on sales contracts, mortgages, or other real estate documents. Please be advised, in particular, that many states require specific real estate disclosure statements to be provided to a prospective buyer. This particular form may be used for setting down an agreement to buy and sell property. It contains the basic clauses to cover situations that will arise in most typical real estate transactions.
A Bill of Sale for any personal property, Warranty Deed, Seller’s Affidavit of Title, and Closing Statement, will need to be prepared for use at the closing of the sale. You will also need to supply the buyer with a copy of the federal booklet: “Protect Your Family from Lead in Your Home” at the time that this Agreement is signed, if the building for sale was built before 1978.
